Job Applicant Privacy Notice

Raw Selection Ltd (“the Company”) is the Data Controller of your personal information for the purposes of the recruitment process.

2. Purpose of this Notice

As part of the recruitment process, Raw Selection Ltd collects and processes personal data relating to job applicants. We are committed to handling this information responsibly and lawfully, in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

This notice explains what data we collect, why we collect it, how it is used, and your rights as a data subject. It applies to all job applicants, whether applying directly or through a recruitment agency. This notice is non-contractual.


3. What Data We Collect

We may collect and process the following categories of personal data:

  • Name, address, contact details, and date of birth
  • CV, covering letter, interview notes
  • Work history, qualifications, skills, and experience
  • Information about your right to work in the UK
  • Copies of qualifications or professional certifications
  • Driving licence (if required for the role)
  • Information provided in application forms or pre-screening
  • References and feedback from current or former employers or colleagues
  • Information gathered from background checks

We may also collect special category data (with your consent or where legally required), including:

  • Health-related information (e.g. disabilities or adjustments)
  • Criminal convictions and offences (where lawful and proportionate)
  • Equal opportunities data (e.g. ethnicity, religion, gender, sexual orientation – anonymised or consent-based)

4. How We Collect Your Data

We collect data:

  • Directly from you (e.g. via CVs, interviews, application forms)
  • From third parties such as recruitment agencies, previous employers, professional referees, or background check providers
  • From public sources (e.g. Companies House, LinkedIn, professional registers)

We will not contact your current employer without your explicit written consent.


5. How We Use Your Data

Your data is used to:

  • Assess your suitability for the role
  • Manage the recruitment process
  • Make recruitment decisions
  • Carry out background and reference checks
  • Comply with legal obligations (e.g. right to work checks)
  • Monitor equal opportunity practices (where anonymised or consented)
  • Protect the integrity of our hiring practices and business

Legal Bases for Processing:

We rely on the following legal grounds:

  • Article 6(1)(b) – necessary for entering into a contract
  • Article 6(1)(f) – legitimate interests of the Company (e.g. hiring suitable staff, protecting client confidentiality)
  • Article 6(1)(c) – legal obligation (e.g. right to work, regulatory requirements)
  • Article 9 – processing of special category data with consent or where necessary for employment law
  • Schedule 1, DPA 2018 – processing criminal data where lawful and necessary

6. References and Background Checks

Raw Selection Ltd conducts thorough pre-employment checks after issuing a non-contractual conditional offer.

We require three satisfactory references from previous line managers or company directors. We may also seek informal feedback from individuals not directly named by you but who have supervised your work, excluding your current employer (unless you give written consent).

We may also carry out proportionate background checks, which could include:

  • Identity verification
  • Employment and education history
  • Professional memberships and qualifications
  • Criminal record checks (where lawful)
  • Credit or financial checks (if proportionate to the role)
  • Directorship and conflict of interest checks
  • Public domain reviews (e.g. LinkedIn, Companies House)

All offers are conditional and may be withdrawn if checks are unsatisfactory, or if any material misrepresentation is found.

This right to withdraw the offer remains in place even after acceptance and up to your formal start date.


7. How Long We Keep Your Data

  • Unsuccessful candidates: Personal data is retained for 6 months after the recruitment process ends.
  • Successful candidates: Data will form part of your HR file and be retained in line with our employee data retention policy.
  • In some cases, we may retain anonymised or statistical data for longer (e.g. diversity monitoring).
  • If you consent to being contacted about future roles, we will retain your data for an additional 6 months, or until consent is withdrawn.

8. Data Security

We have appropriate technical and organisational measures to safeguard your data. Access is restricted to authorised personnel on a need-to-know basis.

Third-party data processors are contractually bound to comply with data protection law and confidentiality obligations.


9. Your Rights

You have the right to:

  • Request access to your data
  • Request correction of inaccurate data
  • Request erasure (in some circumstances)
  • Object to or restrict processing
  • Withdraw consent (where applicable)
  • Lodge a complaint with the ICO: www.ico.org.uk

10. International Transfers

We do not currently transfer your data outside the UK or EEA. If this changes, appropriate safeguards will be applied and you will be informed.


11. Automated Decision-Making

No hiring decisions are made solely by automated means.

We may update this privacy notice from time to time. Any changes will be communicated to you or made available on request.
